1. General Rules
Kale CAM， Operated by Yingyu Xu, users must comply with the following provisions and conditions ("Provisions") contained in these Kale CAM Terms of Use ("Terms of Use") to provide services ("Services"). Kale CAM may update the terms of use from time to time at its own discretion without prior notice. Once Kale CAM updates the terms of use, Kale CAM will publish the updated version of the terms of use on its website. The updated version of the terms of use shall take effect immediately upon publication and replace these terms of use.
Before using the service, you should carefully read the terms of use. If you do not wish to accept all or part of these Terms of Use and any future updates to these Terms of Use, please stop using all services and immediately cease using Kale CAM. If you use this service, you agree to be bound by these Terms of Use, including any future updated versions, and become a Kale CAM member ("Member" or "You").
2. Service Description
Kale CAM provides members with the following services: taking photos with an analog camera. Any improvements or developments to existing service features, including new product releases, are subject to the terms of use, unless otherwise explicitly stated in these terms of use. You acknowledge and agree that the service is provided as is, and Kale CAM shall not be liable for any delay, deletion or deletion, transmission error, save failure or other issues with member information or personal settings. Kale CAM reserves the right to suspend any part of the service for maintenance, updates, or other purposes without prior notice.
3. Comply with the Applicable Laws
You agree to comply with the applicable laws and regulations of the People's Republic of China ("China") and are responsible for any use of your account (as defined below) and services under your password in any way. If you violate any applicable laws and regulations that may constitute a crime, you will bear all legal responsibilities and may be subject to criminal prosecution. Meanwhile, if Kale CAM reasonably believes that any of your actions, including but not limited to your speech and other behavior, violate or may violate any applicable laws and regulations, Kale CAM may cease to provide services to you without further notice.
4. Providers’ Obligations
According to relevant laws and regulations, Kale CAM reminds you that the provider of content ("Provider", content defined as follows) shall be responsible for any text, news, materials, music, images, graphics, videos, messages or other information ("Content") publicly or privately published or uploaded through Kale CAM. Kale CAM only provides storage space for members and cannot control the content transmitted through Kale CAM. Therefore, Kale CAM cannot guarantee the correctness, completeness, or quality of the content. You understand that by using this service, you may come into contact with offensive, inappropriate, or offensive content. Kale CAM shall not be responsible for any content under any circumstances, but Kale CAM has the right to terminate the transmission of such content and take action, including but not limited to suspending the use of all or part of the services by members, and retaining records and reporting to relevant authorities.
5.Members’ Use of Kale CAM
All members agree that they shall not participate in any illegal or inappropriate activities through the use of the service, including but not limited to the following activities:
1）Publish or transmit information containing the following:
*Oppose the principles established by the Constitution
*Endangering national security, leaking state secrets, subverting state power, and undermining national unity
*Harming national honor and interests
*Incite ethnic hatred or racial discrimination, or undermine ethnic unity
*Disrupting national religious policies, promoting cults or superstitions
*Spreading rumors, disrupting social order, and disrupting social stability
*Spreading obscenity, pornography, gambling, violence, murder, terror, or inciting others to commit crimes
*Insult, defame others, and infringe upon their legitimate rights and interests
*Contains content that is defamatory, slanderous, malicious, coercive, obscene, vulgar, defamatory, obscene, obscene, or morally offensive to others
*Prohibited or restricted by laws and administrative regulations
*Kale CAM is considered unsuitable for display
(2)Infringe upon the legitimate rights and interests of others in any way
3）Falsifying any other individual or organization, or making false statements or providing false information related to any other individual or organization
4）Transmitting any unauthorized content obtained under any law, contract, or legal relationship through publication, email, or any other means (such as internal, proprietary, or confidential information obtained through confidentiality agreements or employment relationships)
5）Publish or transmit content that infringes any third-party copyright, patent, trademark, trade secret, or other proprietary right ("Exclusive Right")
6）Transmitting any advertisements, promotional materials, "junk mail," "spam letters," "chain emails," "direct marketing emails," or any inducement materials through publication, distribution, or any other means
7）Transmitting any computer virus, computer code, file, program or any material through publication, distribution or any other means to interfere with, damage or restrict the functionality of any computer software, hardware or communication device
8）Interfering with or damaging the service or the network related to the service, or violating any regulations, plans, policies, or rules of the network related to the service
9）Harassing others through tracking, online pursuit, or other means
10）Intentionally or unintentionally violating any applicable local or national laws or any effective regulations
11）Without legal authorization, intercept, tamper with, collect, store or delete personal information, internal emails or other data of others, or use such materials for illegal or inappropriate purposes
You acknowledge that Kale CAM cannot fully control the activities of its members. You agree that when you use any content, including relying on the accuracy, completeness, or usefulness of the above information, you will make your own judgments and assume risks, and Kale CAM is not responsible for such risks. However, Kale CAM may, at its discretion, refuse and remove any content provided in violation of the terms of the service, or any content that Kale CAM may find offensive
You acknowledge and agree that Kale CAM has the right, in accordance with laws and regulations, or for the following purposes, to store or disclose content in good faith within the necessary scope:
a）Comply with legal procedures
b）Execute the terms of use
c）Responding to any third-party claims
d）Protect the rights, property or personal safety of Kale CAM, members and the public
e）Other situations deemed necessary by Kale CAM
6. Special Warning for International Use
You acknowledge the non-state boundaries of the internet and agree to comply with local laws and regulations regarding online behavior. In addition, you specifically agree to comply with applicable laws and regulations regarding information transmission in China or the country or region where you reside
7. Disclaimer
1）The member expressly agrees that he/she shall bear full responsibility for the risk that the text, information, materials, music, pictures, graphics, videos, information or other personal information uploaded by him/her to the Internet may be copied or reproduced by other entities or individuals for other purposes. Members shall be fully responsible for all consequences of using Kale CAM services, and Kale CAM shall not assume such risks for members
2）The member's text, information, materials, music, images, graphics, videos, messages, or other personal information used for promotion on official accounts (such as Weibo or WeChat) do not infringe on the member's relevant rights, and Kale CAM assumes no responsibility for this
3）If any member reports, Kale CAM will take action to remove malicious comments directed towards the member, but Kale CAM cannot guarantee that such actions will satisfy the member, and Kale CAM is not responsible for such malicious comments
8. Supplementary Provisions
In view of the rapid development of the Internet industry, the terms and conditions ("regulations") specified in this refund policy cannot fully enumerate and cover all the rights and obligations between members and Kale CAM. This regulation is also subject to the current service policies updated from time to time on Android or iOS systems. Kale CAM may modify this refund policy from time to time in accordance with applicable Chinese laws and regulations, as well as Android or iOS subscription service policies, to maintain normal service order or protect the rights and interests of members. The revised refund policy will be communicated to members through legal or agreed upon procedures and will take effect in accordance with applicable laws and regulations
